Justice Ketanji Brown Jackson was equally pointed in her dissent: “The Court has come to rest on the bottom-line conclusion that racial diversity in higher education is only worth potentially preserving insofar as it might be needed to prepare Black Americans and other underrepresented minorities for success in the bunker, not the boardroom.”

If you are under the misperception that race-conscious policies allow the admission of unqualified Black and brown students, decades of data have shown that’s not so. Applicants are judged on their high school academics, extra-curricular activities, athletics, and, not coincidentally, their status as a “legacy” — meaning an immediate family member attended. Race is also considered.
