As for when that belief is considered reasonable, the law says the person must know or have reason to believe the other person either tried to enter or entered unlawfully and with force their home, vehicle or workplace and either:Was committing or trying to commit aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery or aggravated robbery.
To resist an arrest or search that the person knows is being made by a peace officer or by a person acting in a peace officer’s presence and at his direction.If the person provoked the other’s use or attempted use of unlawful force — unless the person abandons the encounter and the other person continues or attempts to use unlawful force against them.These elements in state law fall under the Castle Doctrine — removing the duty to retreat in one’s home, workplace or vehicle.
The person must believe the immediate use of force is necessary “to prevent or terminate the other’s trespass on the land or unlawful interference with the property.”
