“The U.S. Supreme Court has consistently held that a party cannot be forced to arbitrate without a finding that she agreed to do so,' reads the statement filed by Erica Herman's attorney.
Tiger Woods' personal life is back in the headlines in a negative way. USA TODAY's Brent Schrotenboer has details of the latest lawsuit against Woods by ex-girlfriend Erica Herman. The former girlfriend of Tiger Woods has filed a request with a state court in Florida to reconsider athat sent her public dispute with the famed golfer to private arbitration proceedings instead of public court.
“The U.S. Supreme Court has consistently held that a party cannot be forced to arbitrate without a finding that she agreed to do so, which means that in this case — with no evidence in the record — arbitration should not be compelled, or, at a minimum, an evidentiary hearing should be held,” said the document filed by Herman’s attorney, Benjamin Hodas.
In response, Woods’ attorney said the NDA is “valid on its face” and the judge agreed in her ruling May 17, noting Herman never actually denied signing it. Woods then sought to steer the dispute into private arbitration before Herman filed another lawsuit in March, this time against Woods himself.
