The “friend of the court” brief was filed because the appeal concerns the contours of the authority held by commissioners, CCAP explained. Leete’s finding that the Code gives the payroll, accounts payable and general ledger functions exclusively to Rogers lacks statutory support and conflicts with the precedent of the state Supreme Court, it claims.
Under Leete’s interpretation of the code, the commissioners could appropriate monies and set taxes but would have little other authority over the fiscal affairs, the organization contends.
