Courthouse News Service filed the lawsuit in federal court in Cleveland. The California-based publication accused Cuyahoga Co. Clerk of Courts Nailah Byrd's policies of violating longstanding rights by the media and public.

In Cuyahoga County, Byrd’s office makes the new documents public only after someone in the office reviews and processes the filing. Courthouse News Service reporters publish the names of new cases filed each day in areas across the country. It started covering Ohio in 2003, when reporters were allowed to sit behind the counter with clerk’s office employees as long as they wore a shirt and tie, according to the lawsuit.
