On Monday, Ivey appointed Madison County District Judge Patrick Tuten to fill the new seat in that county. “It’s no coincidence that the Alabama Judicial Resources Allocation Commission weaponized it’s unconstitutional authority to steal a judgeship based in a diverse community and send it to a white community,” Ahmed Soussi, voting rights staff attorney with SPLC said in a press release. “Through this litigation SPLC will work to ensure that Jefferson County is fairly represented in the judiciary, and that their courts have adequate resources to address the needs of the community.
Hudson won a contested Democratic primary for Jefferson County Circuit Court Place 14 on May 24. That put Hudson in line to take the bench in January because there was no Republican nominee in the general election. The lawsuit asks the court to require Ivey to follow a process for filling judicial vacancies in Jefferson County. According to the lawsuit, amendments 83 and 110 to the state constitution require the governor to appoint one of three nominees submitted by the Jefferson County Judicial Commission. The appointee is to serve until the next general election at least six months after the vacancy arises. In this case, that would be until November 2024.
