It’s at least the third lawsuit filed in San Antonio in the past year against a fast-food chain over coffee.

for more than $1 million in damages for burns he sustained after being served hot coffee in what he alleges was an improper cup.

Jonathan Havens, a Houston lawyer representing Vance, said a Whataburger employee handed Vance a “ridiculously hot” coffee in a soda cup. Vance, who Havens said is in his early 40s, and his family filed suit against Whataburger Restaurants last month in state District Court in San Antonio. It has yet to file an answer to the complaint and a Whataburger representative didn’t respond to a request for comment.

Vance has been treated by a doctor and though he has not required skin grafts, is dealing with scarring, his lawyer said.
