Dallas begins building The Loop’s Hi Line Connector despite contractor’s ongoing lawsuit
The decision to start construction is a big turn of events, a story that’s been hiding in plain view since digging began March 24.
“Since the project was bid in November 2021, the $11.5 million approved by City Council no longer covers the full cost of labor and materials,” according to the email from Philip Hiatt Haigh, The Loop Dallas executive director. The details of how this project, now scheduled to be completed by July 2024, moved from the courthouse to the construction site are still coming into focus.Rewind to almost exactly a year ago when the City Council approved an $11.5 million proposal from the Fain Group to build the Hi Line Connector.
After the city filed a notice of accelerated appeal of the temporary injunction last year, there was “no legal impediment preventing issuing the notice to proceed as there is neither a temporary restraining order or injunction in place,” according to a Dec. 2 email Jenkins received from the City Attorney’s Office.The lawsuit brought by company owner Dustin Gadberry remains pending.
The lawyer also reiterated that the only legally acceptable way to proceed is to cancel the contract with Fain and rebid the project. The briefing documents say the change order is necessary to adjust for increases in construction-material costs due to delays outside Fain’s control and to “delete accent lighting and underground electrical service rerouting.”
