Senate Republicans wouldn't freeze judicial vacancies for the next half of the Biden administration even if they win back the majority, said Sen. John Cornyn.
Texan doesn’t foresee another Merrick Garland situation if GOP regains the majority, though they froze a Supreme Court seat for Obama’s last 11 months.
Garland, now the attorney general, was Obama’s nominee to fill the vacancy created in February 2020 whenSen. Ted Cruz, R-Texas, was among the first to demand the vacancy remain frozen until after the election, arguing that in an election year, voters should decide which party to empower to fill a lifetime seat on the nation’s highest court.
Amending their rule of thumb about the need to freeze Supreme Court vacancies in an election year, Cornyn, Cruz and others argued that when the same party controls both the Senate and White House, delay is not necessary.
