Close Texas’ dead suspect loophole that shields police from scrutiny | Opinion

A Uvalde police SUV passes by a memorial in honor of the 21 victims of a mass shooting at Robb Elementary School in Uvalde, Texas on Wednesday, June 1, 2022.Uvalde families suffered setback after setback this legislative cycle, with a majority of state lawmakers resisting agonized calls to tighten gun rules in Texas.

But these families, and Texans more broadly, secured an important win with the help of Rep. Joe Moody, D-El Paso. The House and Senate passed legislation that will make it easier for the public to get information about crimes involving a dead suspect. Despite overwhelming approval, House Bill 30 went missing in the last days of the Legislature in what appears to have been an act of political maneuvering. The good news is that the bill reappeared, with all the proper signatures, and has been sent to the governor.

The bill — only a single extra subsection in the Public Information Act — makes a major and welcome revision to the state’s open-records law. As it stands, the act allows police to withhold records regarding active investigations as well as investigations that did not result in a conviction or deferred adjudication.
