Sixteen residents in Aurora have sued the city’s mayor and city council in an attempt to stop the construction of an apartment complex near their gated golf course community.

The Garrett Cos., an Indiana-based builder of apartment complexes, intends to turn a vacant 15-acre lot at East Aurora Parkway and South Quemoy Way in southeast Aurora into Echelon at Eagle Bend. The complex would have 260 units inside a dozen buildings. “I am requesting, on behalf of 800-plus residents who have signed petitions, that the Echelon development not be allowed to move forward as designed,” said Harry Brust, the lead plaintiff in the case, during a March 8 hearing before the planning commission.
Robert Holtschlag, another neighbor who joined last week’s lawsuit, testified March 8 that Heritage Eagle Bend is an age-restricted and gated community with “low-profile, single-family” homes that are much different than Echelon’s proposed “urban-scale” buildings.
