Federal court tosses Berkeley gas ban

A three-judge panel on the Ninth Circuit Court of Appeals found that Berkeley's ban on natural gas systems was pre-empted by the Energy Policy and Conservation Act, a 1970's era law designed to conserve American oil and natural gas resources. The rise of local bans on natural gas has drawn regular criticism from suppliers, limiting domestic demand at a time hydraulic fracturing and horizontal drilling had opened up vast new gas reserves in the United States.
