Two bills to tackle the rise in hate-based harassment — whether on race or identity — are undergoing fiscal impact review after gaining bipartisan support in the California Legislature.
There already are hate crime laws in California, such as Penal Code 422.55 PC. But these new bills aim to address a wider variety of behavior motivated by hate, including shouted slurs, sexual harassment and physical intimidation based on traits like race, gender and sexual orientation.
“Public transit is a lifeline for many people, and yet too often people who are dependent on public transit do not feel safe,” said state Sen. Dave Min of Orange County’s District 37, author of SB 1161, during a hearing with the Assembly Transportation Committee. He noted that lower-income households are more likely to take public transportation, and that “addressing harassment on public transit is a matter of equity.
However, the figures do not paint a full picture of what minority communities face in public spaces, according to Shanti Elise Prasad, advocacy manager of Chinese for Affirmative Action. Jupiter Peraza, director of Social Justice and Empowerment Initiatives at San Francisco’s Transgender District, told of her own encounter with harassment as an example of how such “hate incidents” that may not be crimes but could be harmful, and deter her from going to public spaces.
