Notations on the online court file show that two trial dates for Benton, one in April and one in October of 2021, were rescheduled. There is a gap between November of that year and the following May when nothing appears to have happened in the case. Starting in May 2022, court filings ramped up, leading to the trial in November that ended with Benton’s conviction.

Nothing in Simmons’ court file shows he had previously tampered with his monitor, but statistics about defendants like him are discouraging. According to a recent report by Dallas County’s pre-trial department, last year it closed out 1,771 cases of defendants on electronic monitoring, the highest level of pre-trial supervision, usually reserved for suspects in violent crimes and sex offenses. About 30% were either taken back into custody, accused of new offenses or absconded.
